A District of Columbia (DC) Bar Association Disciplinary committee released a report Friday recommending that former Trump attorney Rudy Giuliani be disbarred and prevented from practicing law due to his involvement in lawsuits attempting to overturn the 2020 presidential election results. Giuliani was Mayor of New York City from 1994-2001, a 2008 presidential candidate, a cybersecurity advisor to former President Donald Trump and Trump’s personal attorney for much of Trump’s presidency.
The report sharply criticized Giuliani’s involvement in the case Trump v. Bookvar, where the Trump campaign attempted to overturn mail-in voter results from mainly Philadelphia and Pittsburgh due to a “voter dilution” theory based on the Electors and Elections clauses of the constitution. The report goes on to allege that “Mr. Giuliani did not offer any evidence that fraudulent mail-in votes were actually cast or counted.” The committee ultimately found that Giuliani violated Rule 8.4(d) and Rule 3.1 of the Pennsylvania Rules of Professional Conduct for his “frivolous” and “implausible” allegations made during the lawsuit. The report concludes, saying:
We have considered in mitigation Mr. Giuliani’s conduct following the September 11 attacks as well as his prior service in the Justice Department and as Mayor of New York City. But all of that happened long ago. The misconduct here sadly transcends all his past accomplishments. It was unparalleled in its destructive purpose and effect. He sought to disrupt a presidential election and persists in his refusal to acknowledge the wrong he has done. For these reasons, we unanimously recommend that Mr. Giuliani be disbarred.
Ted Goodman, a political adviser to Giuliani, dismissed the allegations in the report, saying, “The decision-makers at the DC Bar Association are nothing more than an arm of the permanent regime in Washington.”
The current DC investigations into Giuliani’s alleged misconduct were initiated in 2022. However, calls for Giuliani’s disbarment have been ongoing since the results of the 2020 presidential election were announced. Giuliani has since been temporarily suspended from both the New York and DC Bar associations. Giuliani is currently embattled in several lawsuits related to his fallacious statements surrounding the 2020 election, including a defamation suit filed by Georgia poll workers.
Giuliani has alleged that 600,000 “unlawful votes” were counted in Pittsburgh and Philadelphia, areas central to the Bookvar lawsuit. However, the Pennsylvania Department of State has roundly dismissed these claims. Giuliani has also made similar allegations about “over-votes” in Michigan. However, these allegations have also been dismissed by experts. Despite these and similar claims, experts have found on several occasions that there was no significant fraud during the 2020 election.
The DC Board on Professional Responsibility and the DC Court of Appeals will now consider the committee’s report and will make a final decision as to Giuliani’s potential disbarment.
