A Pennsylvania Commonwealth Court Judge ruled in favor of the Trump campaign Thursday, finding that ballots may not be counted if the voters failed to provide proof of identification by November 9.

The court order by Judge Mary Hannah Leavitt says Secretary Kathy Boockvar lacked the statutory authority to allow the change of deadline for certain votes that arrived after election day. Leavitt cited Section 201 of the Pennsylvania Election Code to show that Boockvar lacks the authority to change the deadline set forth in Section 1308(h), which gives absentee voters six days after the election to cure their ballots by verifying the signature.

Boockvar had allowed voters an extra three days to cure their signature in response to the Pennsylvania Supreme Court extending the deadline for absentee ballots to three days after the election so long as they were postmarked by election day.

This is all part of the legal challenge that President Donald Trump’s campaign is currently bringing in to prevent all mail-in ballots received after election day from being counted.
