California governor vetoes bill promoting rehire of employees laid-off due to Covid-19

California Governor Gavin Newsom has vetoed a bill that would promote the rehire of employees laid-off due to Covid-19.

Under Assembly Bill 3216, an “employer shall offer its laid-off employees . . . all job positions that become available . . . for which the laid-off employees are qualified.” The bill requires employers to notify laid-off employees of such positions via mail, email, and text message, if possible.

The bill allows an employer to hire someone other than the laid-off employee if the laid-off employees lacks qualification. However, if done, the employer must provide written notice of their reasoning to the laid-off employee within 30 days.

In vetoing the bill Wednesday, Governor Newsom said that it placed “too onerous a burden on employers” already experiencing difficult times. Despite his veto, Newsom encouraged California’s legislature to “consider other approaches” to help employees laid-off due to Covid-19.
