Judge David Briones of the US District Court for the Western District of Texas ruled Wednesday that President Donald Trump’s attempt to allocate military funds to construct a wall along the Mexican border was beyond his constitutional authority.
Trump intended to use Pentagon funds to build a wall on the southern border of the United States, for the purpose of preventing immigrants from coming into the country. Briones found that the damage to the plaintiffs, El Paso County, Texas and Border Network for Human Rights, was irreparable, outweighing the potential benefits created by the wall.
“Because Plaintiffs have demonstrated irreparable harm, an inability of traditional remedies at law to rectify that harm, and the balance of the equities and public interest weigh in their favor, they are entitled to a permanent injunction against use of §284 funds for border barrier construction.”
Briones’ ruling specifically prohibits the use of military funding for the border wall, but does not prohibit other sources of funding for the project.
