Huawei files motion to expedite lawsuit against US government

The Chinese telecommunications giant, Huawei, filed a motion for summary judgment on Tuesday in the US District Court for the Eastern District of Texas to accelerate its lawsuit against the US government.

The lawsuit, initially filed in March, involves Section 889 of the National Defense Authorization Act (NDAA). This provision explicitly prohibits executive government agencies from procuring telecommunications equipment from Huawei and rival ZTE. Huawei argues that the provision in the NDAA unconstitutional since it violates the company’s right to due process.

The company argues that this case presents only questions about law—the NDAA and the US Constitution—and does not at this point involve any dispute over facts. The company can avoid full trial and discovery process if the court grants its motion.

The Texas district court has scheduled a hearing for September.
