Brewery sues over government shutdown

Atlas Brew Works filed a lawsuit in DC District Court Thursday claiming that its inability to sell beer due to the partial government shutdown is a violation of its First Amendment rights.

The brewery is unable to sell kegs of its apricot flavored India Pale Ale named “The Precious One” because of the federal government shutdown, which has halted the agency that approves the beer’s labels. The kegs are unable to be shipped out for sales outside of DC without label approval from the Alcohol and Tobacco Tax and Trade Bureau.

The clock is ticking because the kegged beer will expire 120 days from its production date of January 3, 2019. Atlas is further concerned that the kegs are taking up space that could be occupied by the next seasonal beer, pushing the entire 2019 production schedule, resulting in significant lost revenue.
