The Arizona Supreme Court [official website] issued an order [text] Monday denying in-state tuition for individuals who benefit from the Deferred Action for Childhood Arrivals (DACA) [official website] program.
The Court reviewed the case brought from the Arizona Court of Appeals where that court had ruled [JURIST Report] against in-state tuition for DACA recipients in June 2017.
The Arizona Supreme Court, agreeing with the Court of Appeals, decided that no current federal or state law allows the granting of in-state tuition to DACA beneficiaries. The court acknowledged that other states such as California, Colorado, and New Mexico have provisions for granting in-state tuition but that Arizona does not have a similar statute at the moment.
The Arizona Supreme Court mentioned that a full opinion with an explanation of the Court’s ruling should be issued by May 14, 2018.
