Petitioners are being held under color and authority of the Executive, in violation of the Constitution, laws and treaties of the United States as well as customary international law. This Court should issue a Writ of Habeas Corpus so that Respondents will be required, in this Court, to establish that there is a lawful basis for the detention of the Petitioners.
1. Petitioners seek the Great Writ. Each Petitioner acts on his own behalf.
2. Petitioners are being held virtually incommunicado in Respondents' unlawful custody at various detention facilities located within the Guantánamo Bay Naval Station ("Guantánamo"). They are from some 42 countries.
3. Respondents George W. Bush, President of the United States; Donald H. Rumsfeld, Secretary of Defense; Army Brigadier General Jay Hood, Commander of Joint Task Force-GTMO; Army Colonel Nelson J. Cannon, Commander, Camp Delta, Guantánamo Bay Naval Station, Cuba; the as-yet unnamed Director of National Security; and Porter J. Goss, Director of Central Intelligence, are either ultimately responsible for or have been charged with the responsibility of maintaining the custody and control of Petitioners at Guantánamo.
