Pennsylvania governor signs bill expanding gaming and gambling

Pennsylvania Governor Tom Wolf on Monday signed House Bill 271 [text, PDF] expanding the gaming and gambling industry.

The bill amends Title 3 (Agriculture) and Title 4 (Amusements) of the Pennsylvania Consolidated Statutes and allows for electronic wagering for horse races, creation of Fantasy Sports Contests, and iLottery/internet instant games through your personal electronic device. The legislation additionally creates the Lottery Sales Advisory Council in an effort to encourage further cooperation between the State Lottery and licensed lottery sales agents and augment lottery sales.

Opportunities for casinos have expanded as well. Casinos are able to obtain a limited number of Category 3 and Category 4 Licenses allowing for the addition of more gaming tables and slot machines and are able to enter into a simulcasting agreements with other licensed parties.

The bill seeks to create regulations for governing sports wagering, which largely depends on the pending Supreme Court decision [JURIST Report] in Christie v. NCAA and National Thoroughbred Horsemen’s Association v. NCAA [SCOTUSblog materials], scheduled for oral argument in December.

The Fiscal Note [text, PDF] from the House Committee on Appropriations offers an analysis of these changes and estimates $238.5 million will be added to the General Fund in 2017-2018 from application and licensing fees. Future tax revenues will depend on timing in implementation of the changes.
